The 16-hour exception

Identify the eligible duty tours and what the extra window permits.

LESSON 2 / 2 · A later deadline does not add driving hours

A later deadline does not add driving hours

Separate the sixteen-hour provision from short-haul recordkeeping.

Only the window is extended

The §395.1(o) exception leaves the eleven-hour driving allowance unchanged. Cycle limits and the applicable driving-break rule still apply. It can help when non-driving work uses the window, but it cannot authorize a twelfth driving hour.

A later deadline, the same driving budget

At a glance · Follow the sequence

  1. 01

    Ordinary window

    14 consecutive hours

  2. 02

    Eligible provision

Window can extend to 16 hours

  3. 03

    Driving allowance

Still no more than 11 hours

A longer window cannot make an overlong driving assignment fit.

Apply the later deadline to the actual day, keeping the driving allowance unchanged.

Do not mix eligibility rules

Three separate provisions
ProvisionPurpose
§395.1(e)(1)150-air-mile time-record exception; fourteen-hour release
§395.1(o)Limited sixteen-hour window for qualifying duty tours
§395.1(e)(2)Separate non-CDL property-carrying provision with its own conditions

Use the conditions of the provision you are actually applying. A “16-hour” button is not proof that those conditions are met.
