A limited sixteen-hour window

Section 395.1(o) can extend the ordinary fourteen-hour driving window to sixteen hours for qualifying property-carrying drivers. It does not add driving hours. It is intended for an occasional longer duty tour, not a routine sixteen-hour schedule.

For each of the previous five duty tours worked, the driver must have returned to the normal reporting location and been released there. Duty tours are work periods, not necessarily consecutive calendar days.

The recent work pattern and frequency of use determine whether this longer window is available.

Check today’s tour and recent use

  1. Start after ten consecutive hours off-duty.
  2. Return to the normal reporting location and be released within sixteen hours.
  3. Do not use the exception if it was used in the previous six consecutive days, unless a qualifying thirty-four-hour restart began a new cycle.

Check the actual duty history. An app button or carrier approval does not prove eligibility.
