HOS violations & what happens next

Respond accurately and understand enforcement and carrier history.

LESSON 2 / 2 · Understand how an inspection affects the carrier

Understand how an inspection affects the carrier

Separate internal alerts from reported violations and carrier scores.

What CSA and SMS measure

Compliance, Safety, Accountability (CSA) is FMCSA’s safety oversight program. Its Safety Measurement System (SMS) uses reported inspection and other safety data to assess carriers. An internal ELD alert does not automatically become a reported SMS violation.

A roadside HOS violation can affect the carrier’s assessment. Enforcement and out-of-service decisions depend on the facts and applicable criteria.

Inspection age and severity affect the carrier assessment. Check the official methodology.

Severity and age both matter

The carrier SMS assessment uses twenty-four months of relevant inspection data. It weights recency and severity. The violation code and out-of-service status matter; use the official methodology rather than guessing a score.

The twenty-four-month calculation window is not a deletion deadline for every agency or driver-history record.

Fix the cause

Check whether dispatch, delay reporting, or log review contributed. A reminder to the driver will not fix an unrealistic assignment.
